It was, however, a different stroke for the other accused persons as the oral application for the bail of Michael Igbinedion and Patrick Eboigbodin was turned down by the judge, Adamu Hobon, who then proceeded to commit the two men to prison custody till June 8 and 13, when their written bail application would be taken.

Patrick Eboigbodin and Michael Igbinedion, - younger brother of the former governor - are 2nd and 3rd accused respondents in the 66-count charge brought against Mr. Igbinedion and six others by the EFCC

In the case of the former governor, Mr Hobon ruled that it would amount to double jeopardy and abuse of court process to try the former governor again as he had in 2008 entered into a plea bargain with the EFCC.

The judge held that counsel to the accused persons was able to show evidence that the former governor was tried and convicted of similar offence by the Court of Appeal, Enugu division in 2008 when he entered into the plea bargain.

He also ruled that the preliminary application by the accused persons to strike out the 66-count charge was proper in case of the former governor, but failed in the case of the 2nd to the 7th accused respondents whom the court held did not prove that they had been tried and convicted before.

“However regrettably, none of the 2nd to 7th accused respondents have shown or adduced evidence to show they were earlier tried and convicted before.”

No double jeopardy

“The doctrine of double jeopardy and abuse of court process is not available to them. In fact, some of them escaped from jurisdiction while the trial was on. Their application has failed and is hereby dismissed for lack of merit, frivolities and wanting in evidence,” Mr Hobon ruled.

The 4th to 7th respondents, which include GAVA Corporation Limited, ROMRIG Nigeria Limited, PML Securities Company Limited and PML Nigeria Limited purportedly owned by the 1st to 3rd respondents were represented in court by the accused counsel.

Before making the remand order, charges against the 2nd to 7th accused respondents were read to them, following which they pleaded not guilty.

Hearing in the substantive case was adjourned to the 13th and 14th of July, 2011.

Nigeria were in superb form as they beat Argentina 4-1 in an international friendly at Abuja National Stadium in Lagos on Wednesday evening, claiming their first victory over the South American giants.

 


The Super Eagles produced a stunning first-half display to lead the Argentines 3-0 at halftime in this high-profile international game.

Right from the blast of the whistle, Nigeria’s resolve to beat the South Americans was obvious with Ikechukwu Uche getting the lead in the 11th minute off a shot that took a wicked deflection.

Uche, who had just made his return to competitive action after a long layoff due to injury, was a thorn in the flesh of the Argentines with his mesmerising runs, and played a part of the build-up that led to the push in the back of Victor Anichebe in the box resulting to penalty. While it looked a harsh decision, the spotkick was perfectly converted by Obinna Nsofor in the 26th minute.

A third goal was denied by good defensive work from the Argentines in the 33rd minute, but it did arrive soon after that as Uche headed home at the far post after a perfect cross from the left by Taye Taiwo.

Anichebe was then forced to leave the field before halftime with an injury, with Emmanuel Emenike taking his place.

Early in the second half, a simple opportunity was wasted by Emenike, but he made amends in the 53rd minute by lifting the ball over the Argentine keeper into the net for Nigeria’s fourth goal.

After that the Nigerian side seemed to relax and they decided to string passes together in their own half, a situation the Argentines tried to exploit by throwing more men forward.

In what looked like a game-plan to conserve energy ahead of Nigeria’s crucial 2012 Africa Nation’s Cup qualifier against Ethiopia in Addis Ababa on Sunday, coach Samson Siasia brought on Mohammed Yusuf Ayinla for Chibuzor Okonkwo, Ogwude Fegor for Joel Obi - who showed brilliance in the midfield with Mikel Obi - and Obinna Nsofor was pulled off for Peter Utaka.

A fifth goal was just missed when Ahmed Musa’s cross was just out of Uche's reach.

Argentina were gifted a consolation goal late on when Mauro Boselli converted a penalty in the eighth minute of stoppage time, awarded after the referee somehow spotted a handball in the box.

It was an excellent game in which Nigeria showed dominance and deservedly won.
