OPERATIVES of the Department of the State Security Service (SSS), on Tuesday, quizzed former governor of Lagos State, Senator Bola Tinubu.

According to a high security source, the Action Congress of Nigeria (ACN) chieftain was reportedly quizzed at the SSS headquarters, otherwise known as Yellow House, Abuja.
Though no official reason was given by the SSS for the questioning, the Nigerian Tribune learnt that it might not be unconnected with Tinubu's pending case at the Code of Conduct Tribunal, as well as his recent outburst at the Action Congress of Nigeria (ACN) rally in Ibadan, during which he reportedly called President Goodluck Jonathan a "drunkard."

It was gathered that Senator Tinubu, who received the SSS invitation on Monday, arrived at its headquarters at exactly 3.15p.m. in Abuja, on Tuesday.

According to our source, he was quizzed over his utterances which the service considered as security "risk" but was later released on self recognisance.

"He (Tinubu) has been making some statements considered unhealthy for peaceful coexistence in recent times. The service deemed it fit to interact with him over such issues," a source said.

The former governor is also said to have a case file before the Economic and Financial Crimes Commission (EFCC).

The Nigerian Tribune learnt that the former governor was left off the hook after the questioning around 4.15p.m.

Efforts to get official confirmation on the questioning of Senator Tinubu from the service were not successful as the telephone lines of SSS spokesperson, Maryln Ogar, an Assistant Director of Public Relations, were defective.

However, a top operative in the service, who wanted anonymity confirmed the questioning, saying it was a normal routine that could be extended to anybody.

Meanwhile, with the swearing in of the new acting chairman of the Code of Conduct Tribunal, Danladi Yakubu Umar on Tuesday, the stage appears set for the commencement of the prosecution of past and present public officers indicted for alleged violation of the asset declaration law.

Nigerian Tribune, on Tuesday, exclusively reported the appointment and swearing-in of Umar by the Chief Justice of Nigeria, Justice Aloysius Katsina-Alu...

The covert swearing in reportedly took place around 10.00 a.m at the Supreme Court, with a handful staff of the Code of Conduct Tribunal present.

Code of Conduct Bureau spokesperson, Mrs Idowu Jokpeyibo, confirmed the swearing-in to the Nigerian Tribune, on Tuesday.

It was also gathered on Tuesday night that the Federal Government, through the office of the Attorney-General of the Federation, had almost concluded arrangement for the appointment of two other members that would be sitting on cases with the acting chairman.

The tribunal is a three-member panel, though two members are required to form a quorum.

It was further learnt that the tribunal might start sitting from next week, which would see to the commencement of the trial of Senator Tinubu and others charged before the tribunal by the Code of Conduct Bureau for violation of assets declaration law.

The two members are expected to be appointed and sworn in before the end of the week.

History will be made on October 26, 2010, as 100 million shares of Dangote Cement Plc will be listed by introduction, on a special offer, on the Nigerian Stock Exchange, NSE, at N135 per share.

The listing is sequel to the approval from Federal High Court Lagos sanctioning the merger between Dangote Cement Plc, DCP, and Benue Cement Company, BCC, whereby shareholders of BCC will get one of DCP share in exchange for two of BCC.Photo:Aliko Dangote coming down from Bombardier private Jet.

The enlarged Dangote Cement will constitute over 25 per cent of the entire market capitalization after the listing.

Prior to the listing and special offer day, investors who desire to buy into the offer are expected to make their demands through their stockbrokers. Management of the new company, Dangote Cement, has promised to make any amount of shares required by investors available on the trading floor of the Exchange on the day of listing.

The listing which is the final stage of the merger process is expected to lift the NSE’s market capitalization by about N2.1 trillion.

Following the listing of the new company, shares of BCC will be delisted from the Exchange.
Meanwhile, prospective shareholders in the enlarged Dangote Cement will reap bountifully as the management has also resolved to adequately compensate its investors, in line with the group policy. This much was disclosed in the scheme of merger of both BCC and Dangote Cement.

Financial advisers to the merger, Vetiva Capital management Ltd and Afrinvest revealed that, “…both set of shareholders will continue to enjoy dividend growth in the coming years, taking into account the earnings growth profile of the post merger Dangote Cement Plc and the fact that the prevailing 75 percent dividend payout ratio would be retained.”

A review of dividend history of companies under the Dangote Group listed on the Nigerian Stock Exchange(NSE) indicated that in the financial year ended December 31, 2009, investors received over N23 billion as dividend. The total dividend payout is significant considering the harsh operating environment that arose from the global financial meltdown.

President, Dangote Group, Alhaji Aliko Dangote, who spoke to shareholders assured of immense benefits from the merger which include: reduced operational cost arising from improved efficiency and the remaining five years of tax holiday still being enjoyed by some of the component arms of the emergent company.

According to him: “The proposed merger is conceived with the goal of consolidating the cement producing entities of Dangote Industries Limited in Nigeria under a single entity presenting a robust platform for the enlarged DCP to optimize on available growth opportunities having regard to the present state of the Nigerian cement industry..

This is expected to significantly increase production capacity, boost turnover and profitability and eventually lead to an enhanced dividend payout and capital appreciation for the investors.” “Our reason for listing any of our companies is to take care of shareholders. So far we have given dividend of over N23 billion this

year,” he said. Going by expected revenue growth arising from the merger, among others, he projected that dividend level for the Dangote Group will go to between N50 and N60 billion soon.

In a related development, stockbrokers have endorsed the merger. Chief Executive Officer, Afrinvest West Africa, Mr. Ike Chioke said the merger between the two companies would increase value generation by leveraging positive economies of scale in purchasing and manufacturing.

According to him, “The fact that the merger will account for 25 per cent of the entire market capitalization of the NSE shows that it will boost activities on the exchange. “We are also aware that shareholders in both companies will stand to gain a lot from this merger, as it will benefit them in the area of improved activities, which will translate to higher dividends.”

Another stockbroker, Mr. Tunji Oyebola, said that the merger between the two companies would give the expanded company better access to financing at a low rate, especially as the company would have a larger collection of high quality assets that could be pledged as collateral to lenders.

According to him, “Shareholders of BCC will stand to benefit from the superior production technology of the company, which will also translate to significant cost savings for the company.”

81% of Nigerians will vote next year

Eighty-one percent of eligible Nigerians are willing to vote in forthcoming elections, according to a poll released yesterday.

jpeg&STREAMOID=iXH8GAOYqbU8RsKLSQfdzy6SYeqqxXXqBcOgKOfTXxTBxz3DF6ftWImZ6FoKNZzFnW_PgxgftuECOcfJwS6Jtlp$r8Fy$6AAZ9zyPuHJ25T7a9GKDSxsGxtpmxP0VAUyHL6IDcZHtmM2t7xO$FHdJG95dFi6y2Uma3vSsvPpVyo-The poll, ‘Current Pulse of Nation’s Survey’, carried out on topical national issues, sampled 5000 respondents, aged 18 years and above, from across the country.

‘Current Pulse of Nation’s Survey’ is conducted by Research and Marketing Services (RMS), an affiliate of TNS Global, a market research company and Gallup International’s representative in the country.

Adeola Tejumola, the CEO of the company, during a press briefing to announce the statistics, said the polls was centred on the forthcoming general elections because it is the most topical issue as the country celebrates its 50th Independence Day Anniversary..

‘More Nigerians will vote next year’

Mr. Tejumola said the reason for the high figure could probably be attributed to the “one man, one vote campaign”, or INEC (Independent National Electoral Commission) administration suddenly improved, or just a reflection of the governance of the day.” “The challenges people raise concern for the most were the epileptic power supply, the increasing crime rate, coupled with the regular kidnapping going on, and corruption continues to rank high on the list,” he said. “For me, the fact that people are beginning to be aware that corruption is an issue, that they acknowledge that it does exist and the need to eradicate corruption in itself, is welcoming news.”

Another problem identified as major by the respondents, were low education quality and poor state of basic facilities.

Only 35 percent of the respondents were, however, confident that the forth coming elections will be free and fair, with half of the respondents expressing concerns about the success of the elections, in spite of the 81 percent willing to vote.

Aggrey Maposa, the company’s chief operating officer (COO), said the difference shows that people think the election process has improved, “though not yet perfect.” “Compared with the previous challenges that INEC used to have, people have seen improvements in the process of the elections. Even though, they understand that the process is not yet perfect, they are willing to vote and express their opinion,” he said.

‘Poor power is killing businesses’

Mr. Tejumola also said 81 percent of Nigeria’s eligible voters support President Goodluck Jonathan’s candidature in the race, noting that the polls was conducted before the presidential aspirants announced to run for office. “But it’s not just one-sided; if 81 percent are saying that President Jonathan should run, in the same report, 54 percent are saying they are not happy with the crime rate, 24 percent are saying that corruption is killing them, and 67 percent are saying that the epileptic power supply is killing their business,” he added.

The report also states that 63 percent of Nigerians will consider character in voting for a presidential candidate, while 33 percent would consider political affiliation. Thirty-one percent will consider political ideology and 27 percent will put the content of the manifesto ahead of other things. The poll also shows a slight popularity advantage for the Peoples Democratic Party (PDP), going into the next elections, while Action Congress of Nigeria (ACN) and All Nigeria Peoples Party (ANPP) had marginal drops in the number of respondents planning to vote for them.

Mr. Tejumola, however, advised presidential aspirants to consider Nigerians’ expectations going into the next elections. “Expectations of Nigerians include generation of employment opportunities, dependable electricity to drive national development, poverty eradication and free qualitative education, amongst others; a serious government would want to concentrate on doing these things for the people,” he said.

Mr. Tejumola also said the research was carried out by the company as “its Corporate Social Responsibility”, and promised that the company will continue to sample public opinion on “topical issues affecting the nation.”

Summary:

In the United States, a new law proposal called The Combating Online Infringement and Counterfeits Act (COICA) was introduced last week, andthere will be a hearing in front of the Judiciary Committee thisThursday.

If passed, this law will allow the government, under the command of themedia companies, to censor the internet as they see fit, like China andIran do, with the difference that the sites they decide to censor willbe completely removed from the internet and not just in the US.

Please see the following article from the Huffington Post for more information.

Stop the Internet Blacklist

And if you are a US citizen, please take the time to sign this petition
DemandProgress.org - Petition to Stop the Internet Blacklist!

When it really matters to them, Congressmembers can come together -- with a panache and wry wit you didn't know they had. As banned books week gets underway, and President Obama admonishes oppressive regimes for their censorship of the Internet, a group of powerful Senators --Republicans and Democrats alike -- have signed onto a bill that wouldvastly expand the government's power to censor the Internet.

The Combating Online Infringement and Counterfeits Act(COICA) was introduced just one week ago, but it's greased and ready tomove, with a hearing in front of the Judiciary Committee this Thursday. If people don't speak out, US citizens could soon find themselvesjoining Iranians and Chinese in being blocked from accessing broadchunks of the public Internet...

Help us stop this bill in its tracks! Click here to sign our petition.

COICA creates two blacklists of Internet domain names. Courts could addsites to the first list; the Attorney General would have control overthe second. Internet service providers and others (everyone from Comcastto PayPal to Google AdSense) would be required to block any domains onthe first list. They would also receive immunity (and presumably thegood favor of the government) if they block domains on the second list.

The lists are for sites "dedicated to infringing activity," but that'sdefined very broadly -- any domain name where counterfeit goods orcopyrighted material are "central to the activity of the Internet site"could be blocked.

One example of what this means in practice: sites like YouTube could becensored in the US. Copyright holders like Viacom often arguecopyrighted material is central to the activity of YouTube, but undercurrent US law, YouTube is perfectly legal as long as they take downcopyrighted material when they're informed about it -- which is whyViacom lost to YouTube in court.

But if COICA passes, Viacom wouldn't even need to prove YouTube is doinganything illegal to get it shut down -- as long as they can persuadethe courts that enough other people are using it for copyright infringement, the whole site could be censored.

Perhaps even more disturbing: Even if Viacom couldn't get a court tocompel censorship of a YouTube or a similar site, the DOJ could put iton the second blacklist and encourage ISPs to block it even without acourt order. (ISPs have ample reason to abide the will of the powerfulDOJ, even if the law doesn't formally require them to do so.)

COICA's passage would be a tremendous blow to free speech on the Internet -- and likely a first step towards much broader onlinecensorship. Please help us fight back: The first step is signing our petition. We'll give you the tools to share it with your friends and call your Senator.

A Peoples Democratic Party presidential candidate, Alhaji Atiku Abubakar, has called for a debate, on the economy, among all the presidential aspirants on the economy.Photo Atiku ? this man looks like a Hitman sha

Abubakar, a former vice-President, made the call after submitting his nomination form at the PDP national secretariat on Tuesday in Abuja.

The Adamawa State- born politician said the economy should be the main issue in the 2011 election campaigns.

“The issue of economic recovery for Nigeria cannot be a matter of wishful thinking nor of rhetoric. It is a subject for rigorous analyses and provision of well-thought, viable, practicable and sustainable strategy,” he said.

Abubakar said that all aspirants must be able to tell Nigerians how they intended to confront the challenges of the economy and reposition it for the benefit of all at the shortest possible time.

He said, “Of all the aspirants that have declared interest in the presidential election, I consider myself the most qualified to address the daunting economic challenges facing the country.

“I am the only one who has successfully managed a business and you need extensive knowledge of the private sector to combine its potential with the authority of the public sector to address this challenge.”

The former vice-president said his approach to resolving the economic crisis in the country was contained in a 47-page Policy Document he presented on August 15, 2010 while announcing his intention to contest the 2011 presidential poll.

He said, “We are faced with a job crisis of monumental proportions. Unless we evolve strategies to dealing with the teeming population of young people churned out almost on a daily basis, we may risk the destruction of the next generation.

“If we fail to channel the energies of this huge population, they could be a potent force for instability and social unrest.”

Abubakar, however, stunned journalists when he said that he was not aware that the President had declared his intention to vie for the PDP ticket.

“I didn’t see it (declaration). Honestly, I didn’t watch it,” he said.

Twenty seven out of the 28 PDP governors were among thousands of people that attended Jonathan’s presidential declaration at the Eagle Square on Saturday in Abuja. The event was shown live by some public and private television stations nationwide.

On the reported move by some politicians to produce a consensus presidential candidate among the Northern aspirants, Abubakar said, “There is a process for the emergence of a consensus candidate in the North. It shows that North is even more united if “they” agree to bring out a consensus candidate.”

He also said he was not aware of the support that Jonathan was getting from the northern states.

Reacting to the challenge, the Presidential Adviser to Jonathan on National Assembly Matters, Senator Mohammed Abba-Aji, said the President was ready for such a debate.

“We are ready for it (debate) anytime. The President has talked about all the aspects of the economy when he declared. If they want more, we are ready for them,” he said.

Another aspirant, who is also the Kwara State Governor, Dr. Bukola Saraki, also expressed readiness for the debate.

“We are ready for the debate. That is what we have been calling for. Without such an issue-based debate, we will not be able to get the best candidate. Saraki is ready for it,” one of the governor’s aides, Mr. Billy Adedamola, said.

The plot of the nation's political drama thickens as President Goodluck Jonathan plans to reshuffle his cabinet next week, said sources privy to the decision.

Photo:L-R Head of Civil Service, Steve Oronsaye,Secretary to the Government of the Federation, Yayale Ahmed, Vice President Namadi Sambo and President Goodluck Jonathan at the Federal Executive Council Meeting in Abuja, yesterday

As politicians in the last few weeks focused on zoning and its attendant problems or benefits, Mr. Jonathan, who political watchers say never ceases to surprise, was doggedly entrenching his hold on the nation's polity.

A few days back, he forwarded the names of three nominees to the Senate for approval as new ministers. It was not immediately clear, however, who the new people will replace. The Senate has acknowledged the receipt of the nominees and decided to reconvene Tuesday next week to screen, and possibly confirm them.

Although the Senate would not reveal the identities of the nominees, it was confirmed that the candidates, two men, and a woman, are from Yobe, Delta, and Borno states. A source further confirmed that one of them is a member of an opposition party, the All Nigeria Peoples Party (ANPP).

Curiously, Mr. Jonathan's action is coming nine months to the end of his administration and he still refuses to confirm if he will be contesting in next year's presidential election or not. Former president Olusegun Obasanjo also effected such a cabinet reshuffle towards the end of his second term in 2006 when he re-assigned Ngozi Okonjo-Iweala from ministry of finance to foreign affairs.

The usual suspects

Sources confirmed that the proposed changes will most likely affect the finance minister, Olusegun Aganga and the minister of state for finance, Remi Babalola. It was unclear if Mr Babalola's statement last month that the state oil company, Nigeria National Petroleum Corporation (NNPC) was broke led to his been considered for possible removal. Mr. Babalola had told a group of journalists during a workshop on "Understanding the operations of the Oil and Gas Industry in Nigeria" organised by the NNPC for members of the Federation Account Allocation Committee (FAAC), that the only reason the corporation has not paid the ₦450 billion debt owed to the federal government was "its cash flow problem." He reportedly lost favour with Mr. Jonathan after that statement.

At the federal executive council meeting that took place after Mr. Babalola's comment, the council denied, through Dora Akunyili, the Information minister, that NNPC was insolvent.

"NNPC, from the auditor's account, is a going concern, and does not have solvency issue as a corporation. Therefore, categorically, NNPC is not insolvent," Mrs. Akunyili said.

She added that there will always be an outstanding balance between the federal government and the oil giant because of the regular transactions between them.

One of the nominees is supposed to fill the vacancy in the power ministry which had no substantive minister, apart from the junior minister. The others are expected to fill the junior minister positions in the petroleum and foreign affairs ministries.

Although the cabinet reshuffle was not mentioned during the briefing that followed the federal executive council meeting yesterday, the Presidency is said to be awaiting the senate's endorsement of the nominees whose names are currently en route to the national assembly.

A Federal High Court sitting in Jos, Plateau State has ruled that the tenure of Segun Oni, the Ekiti State governor, ends in 2011, in the controversy over whether a fresh four year tenure started when he won the April 2009 re-run elections in the state.

The judgment in the suit filed by Adunmo Rufus and three others against the Attorney General of the Federation, delivered on Friday by Ambrose Alagoa.

Mr. Alagoa said the re-run election was not a fresh election but a supplementary one which held in some parts of the state, where no elections were held. He also said the oath Mr. Oni took in 2007 is the one recognised by the Constitution while the second oath he took in 2009 was only complimentary.

An Appeal Court’s ruling in Ilorin had on 17 February, 2009 nullified the election of Mr. Oni, and ordered a fresh poll in 63 wards of 10 local governments, out of the 16 local governments in the state, while the results of the remaining six were still considered for the new result...

No precedence

However, Wale Ojo-Lanre, the chief press secretary to Mr. Oni, said in a press statement that the judgment that cannot stand the test of judicial precedence.

“Section 180 (subsection 2a) of the 1999 Constitution is clear on when the tenure of office of governors and presidents ends and this has been settled by the Supreme Court,” Mr. Ojo-Lanre said.

He described the judgment as curious, strange and a pyrrhic victory for those who are desirous of getting power through the backdoor, noting that constitutional matters like the one on tenure of elected public officers can only be settled by the Supreme Court and added that his principal will appeal the judgment.

But in support of the judgement, Rotimi Akeredolu, the Nigeria Bar Association president, described the ruling as a vindication of his position and that of the Bar.

“That is the position of the law,” Mr. Akeredolu said. “The Bar said so, I have said so everywhere. He is fooling himself. I told him openly, I told the deputy governor when we met, and for them to think that the term will start running they are fooling themselves.

“The Constitution is very clear; from the day you are sworn in and he was sworn in 2007. So the election in 10 local governments and in local government like Ido-Osi and the likes will not give him a new tenure,” Mr. Akeredolu said.

“I would say that it is the final World Cup with the current refereeing system,” Jerome Valcke, general secretary of world soccer’s governing body, told the BBC.

FIFA’s past resistance to change appears to be shifting after some wrong calls in the World Cup, most notably Frank Lampard’s disallowed effort for England against Germany that crossed the goalline, and Carlos Tevez’s offside goal for Argentina versus Mexico.

Tevez’s goal was replayed on stadium big screens, heightening fury among Mexican players and fans.

Valcke said the failure to award Lampard’s effort was a “bad day” for organisers.

“We are talking about a single goal not seen by the referee which is why we are talking about new technology,” he said in an interview with the British broadcaster...

“But again let’s see if this system will help or whether giving the referee an additional four eyes will give him the comfort and make duty easier to perform, then why not?” The use of two extra linesmen to check the goalline and penalty area was trialled in the Europa League last season and is to be used in the upcoming Champions League, from the final qualifying round, and Euro 2012 qualifiers.

Blatter’s Apology

FIFA president Sepp Blatter has apologised for the mistakes in South Africa and said it would be a “nonsense” not to look again at the merits of goalline technology such as the Hawk-Eye system used in tennis and cricket.

Valcke said the increased speed of modern soccer had hastened the need for reform.

“The game is different and the referees are older than all the players,” he said.

“The game is so fast, the ball is flying so quickly, we have to help them and we have to do something and that’s why I say it is the last World Cup under the current system.” The FIFA official said soccer’s lawmaking body, the International Football Association Board (IFAB), was unlikely to hold serious discussions on the matter at their next meeting later this month, but rather when they sit again in October.

Yar’adua returns to work next week – Associates – Daily Trust

March 22, 2010 by Bunmi Awolusi

The on-going scramble for positions in a soon to be reconstituted Federal cabinet could shortly hit a brick wall because President Umaru Yar’adua intends to resume duties in his office next week, a top source close to the ailing president told Daily Trust yesterday. However, another family source separately told Daily Trust that Yar’adua will be fit to resume work by the end of next month.

According to the top sources, Yar’adua intends to make a national radio and television broadcast to signal his resumption of work as early as Monday or Wednesday next week. They said Yar’adua may not write a letter to the National Assembly intimating it of his return because he did not transmit a letter before he proceeded on medical vacation, even though his spokesman later said Yar’adua recognised Dr. Goodluck Jonathan as the Acting President.

Both sources said Yar’adua has made much progress physically since his return to the country late last month, and that his remaining medical problem now is speech-related. The sources said the ailing president now walks around the house and also around the garden, where there are many birds and animals.

They said Yar’adua brought a speech therapist with him from the Saudi Arabian hospital and the doctor has been working since then to improve his speech. Both sources said he has made progress in his speech. One of the sources told Daily Trust that Yar’adua’s return to the country last month was “premature,” and that he was brought back before he finished his therapy “for political reasons.”

There were indications yesterday that the Royal Palace of the Kingdom of Saudi Arabia may be getting increasingly uncomfortable with the continuing stay of President Umaru Musa Yar’Adua at the King Faisal Specialist Hospital, Jeddah, as they believe “he is well enough to travel back to Nigeria to continue his recuperation,” diplomatic sources told THISDAY. Yar’Adua left Nigeria for Saudi Arabia to seek medical attention for acute Pericarditis, a heart-related disease, 62 days ago. While the Saudis are “happy and indeed honoured” to host the Nigerian leader, they are worried that “his continuing stay in hospital may lead to other complications resulting from long hospitalisation which may expose him to other ailments.” Signals from the Saudi Royalty coupled with last Friday ruling by the Chief Judge of the Federal High Court, Justice Dan Abutu, that the Executive Council of the Federation should within 14 days make public resolution to determine the state of health of the president have intensified the pressure on him to return home to restore his presidency in the face of mounting protests at home over his continuing stay abroad and refusal to constitutionally hand power to Vice-President Goodluck Jonathan to act on his behalf. Aside from the Saudi authorities growing unease and the court ruling, the statement on Thursday by former President Olusegun Obasanjo calling on Yar’Adua to take the path of honour and morality if his health would not allow him to perform his responsibilities, has also become a strong source of pressure on Yar’Adua to return to Nigeria as many of his supporters, especially among governors and lawmakers are jumping ship in droves. Obasanjo’s statement had divided the Peoples Democratic Party (PDP) as some believe the ex-president had spoken the minds of many party leaders who are only exercising restraints for the sake of decorum. The Saudi authorities believe doctors have done their work and that he is well enough to return home while the rest can be taken care of by Nigerian doctors and post-hospitalisation consultations. THISDAY checks reveal that Yar’Adua often moves around his hospital suite unaided but may have lost as much as eight to 10 kilos of his normally lean weight, prompting his wife, Turai and family members to wanting him to regain some of his weight and stability before returning home. It is also believed that his continuing stay in hospital could lead to unenvisaged problems, which long stay in hospital can bring, especially through nurses and other hospital staff. The Saudis are believed to be reaching out to influential Nigerians to urge the First Lady, Turai, to persuade her husband to return home as soon as possible. Hajia Yar’Adua, the Nigerian Ambassador to Saudi Arabia, Ambassador Abdullahi Aminchi, who was deputy to Yar’Adua as governor of Katsina State, and a few personal aides are said to be the only ones that have access to the President at the hospital. The access, is said not to always translate to influence while those with influence and constitutional authority have no access to the President in his hospital suite. The Saudi thinking feeds on the political dynamics in Nigeria. For example, it is believed that the Friday court ruling has added to the pressure on ministers who will now have to show their hands in the face of mounting public outcry. The full import of the ruling is such that in line with the provision of Section 144 of the 1999 Constitution, ministers cannot take an informed decision to comply with the court ruling without access to the president by the minister of health and other senior cabinet members. Said an analyst in Abuja, “how can ministers pass a resolution on the health of the president they have not seen or spoken to? Such a resolution would not only expose them to legal challenges, but make them a laughing stock of the nation. For them to pass a credible resolution, they must have access to the president.” It is also believed that since the last Thursday statement by Obasanjo on the options available to Yar’Adua, there are fears in the president’s inner circle that he may return to Nigeria and become a president lacking in crucial support as several governors and lawmakers have jumped ship. The fear of the unsettling impact of the various developments on Yar’Adua’s absence from the country may be constituting intense pressure on the President to return to Nigeria earlier than he and his wife have envisaged and that may be as early as next week.

I saw the embattled pioneer chairman of the Economic and Financial Crimes Commission for the first time at a 'state of the nation' symposium organised by the Nigerian Liberty Forum at the Metropolitan University, London, on May 29, 2009. A man whose slender frame and boyish looks often mask his lion heart and iron resolve, Mallam Ribadu easily stole the show at the gathering. He was literally mobbed as he entered the hall, and as he stood to speak, almost everyone, as if by some sort of invisible instigation, stood up in respect, and remained standing for a long time. I was never a fan of Nuhu Ribadu's methods as the EFCC chairman. I still hold the EFCC under his watch partly responsible for the joke that was the 2007 elections. I had written about his recent travails as a comeuppance for his misdeeds as chairman of the financial crimes buster. I had strongly disagreed with arguments that he meant well despite his obvious excesses, noting that even the road to hell is paved with good intentions. Ribadu spoke on Nigerian unity, making what some people would regard as a populist appeal for Nigerians to overcome their differences and come together to reclaim the Nigerian state from the grips of a corrupt and visionless elite. He argued that there was really no substantial difference in the needs and aspirations of ordinary Nigerians, irrespective of their ethnic and other primordial differences, because "all they ask for are the basic necessities of life." For Ribadu, the Nigerian elites like to harp on the differences among Nigerians because it is in their interest to do so, to "keep us divided". He called himself a simple Fulani man, whose role model had always been Gani Fawehinmi, a man he said he would name Abuja after, if he had his way. He rhetorically asked, to thunderous applause, whether we are being fair to the likes of Wole Soyinka and Anthony Enahoro, who had given over 50 years of their lives to the struggle to make Nigeria better, but are still forced to remain in active service. in their old age, because the problems of the country appear to remain intractable. I respected Mallam Ribadu for not using the forum to get back at the Nigerian government, his current traducers. He wisely focused on positive messages, admitting that mistakes were made when he was boss of the EFCC. There was something about the way he spoke that touched most people in the audience, including those of us who are his ardent critics. It was easy to believe that he spoke from his heart rather than from his head. As Ribadu spoke, I noticed that a Nigerian lady sitting next to me was struggling to hold back her tears. "This is a very honest man, a very rare Nigerian," she muttered, more to herself. I tried to engage her in a discussion. I agreed that Nuhu was obviously an honest man, who meant well and had a lot of passion for the job he did as EFCC chairman. I however disagreed that his good intentions were enough excuses for some of his unacceptable methods. Her facial expression changed as if I had uttered a heresy. "Whether any one likes it or not, he will be our next president," she muttered and moved farther away from me as if to clearly indicate that she did not want to pursue that discussion any further. Nuhu Ribadu for president? Though not his supporter, I have always believed firmly that in Nigeria's game of musical chairs, his rehabilitation would be only a matter of time, and his traducers would inevitably one day take their own turn of being painted as villains. This is one of the iron laws of our politics: there are no permanent messiahs or permanent villains. Just think of Abacha, the poster boy of Nigerian dictatorship and corruption, and the efforts made not long ago by a section of the country to rehabilitate him. In the Tube (underground train) on my way home from the symposium, I found myself standing next to three gentlemen who had apparently also attended the event. The discussion was again on Nuhu Ribadu. "He is very inspirational. He is our Obama," one of the three men, who looked Caucasian to me, declared. I decided to barge into the discussion but resisted the temptation to ask the gentleman if he was indeed Nigerian. I asked whether the genius of Obama was because he was inspirational or because he was post-racial, and a reconciler, with wisdom and a good organisational sense. "Nigeria needs an enlightened leader who can inspire confidence in Nigerians, whom Nigerians will be proud of, and who genuinely wants to transform the country," he declared. I agreed that Ribadu inspires confidence and will make a genuine effort to transform Nigeria if he becomes president of the country, but again expressed concerns about his democratic credentials. I reminded them that when he was boss of the EFCC he virtually kidnapped or forced some House of Assembly members in Plateau State to impeach their governor. I also reminded the three gentle men that during the 2007 elections Ribadu appeared to sit in his office and decide which people to disqualify from running for office before finding evidence against them. "I don't think you will vote for him, will you? Your question to the founder of Sahara Reporters [the online blog] gave you away," the bulkiest of the three, with obvious Nigerian features, said, with a smile of superior wisdom. I had asked Omoyele Sowore if he ever saw anything good in the Nigerian government. I also accused him of appearing to romanticise the Niger Delta militants, and of failing to distinguish between the cause they espouse (which most Nigerians support) and their methods (which many find abhorrent). "Look brother," began the third man, "we Nigerians made Obama President of the United States. More than 25 percent of the people who organised and knocked on doors for Obama are Nigerians. Nuhu is not perfect. But do you think any of the people currently being touted as presidential candidates in Nigeria will be better than Nuhu?" He had a slight Igbo accent. I agreed with him that if Nuhu ever became Nigeria's president, it would never be business as usual and that he would be prepared to give his life to make a difference. I however once again reiterated my concern about his antecedents, including a tendency to be carried away by emotions. As we disembarked and went our different ways, what became obvious to me was that Nigerians had not heard the last of Nuhu Ribadu.
